Our Terms and Conditions of sale are guidelines to which we process all customer orders. By placing an order with THEAUDIOWORKSUK.COM you are agreeing to the following Terms and Conditions of sale.

2. HARDWARE & OTHER PRODUCTS - All hardware products are boxed and brand new unless clearly stated otherwise or are listed in our 2nd hand / ex-demo section.

3. ORDERS - We make every effort to ensure hardware products we supply are of the highest quality, reach you in good condition, and are delivered promptly. If for any reason you are unhappy with your purchase, or the service you have received from The Audio Works Uk, please use our contact us page located at the home page.

4. PRODUCT DESCRIPTIONS - Many of the products we sell are of a technical nature. Unfortunately it is not practical to publish detailed specifications of all the goods and maintain up to date specifications. Thus all drawings, photographs, descriptive matter, specifications and advertising are for the sole purpose of providing illustrations and approximate descriptions only. A more detailed explanation of hardware can be obtained by contacting our hardware department. This explanation will be based on our own independent product testing and is opinion only. Unless we are specifically asked about requirements or compatibility, we shall assume the customer is aware of what these are. Manufacturers of the products we sell reserve the right to amend their product specifications without prior notice.

5. PRODUCT GUARANTEES - Products are not supplied on a trial basis. Hardware products are covered by their respective manufacturer's warranties. Warranty details and length are included with the product. Usually these will be for a minimum of 12 months. Exceptions are the wear and tear of fader's and crossfader's on mixers, professional use and neglect. Please see our Returns Policy  for further information on items which is located at the bottom of this page.

6. PRICES - We reserve the right to amend our prices without prior notice. Due to current global economic conditions and fluctuating currency values some items from outside the UK may not be available as prices listed .All customers with outstanding orders will be notified of any change in prices before their order is charged and dispatched. All orders are accepted subject to availability of stock at the time of picking the order. Prices are correct at the time of publication or upload to our website. We are not obliged to supply goods to you until we have confirmed acceptance of your order. The acknowledgement email you may receive does not constitute order confirmation, or acceptance.

7. PURCHASING FROM US - We are unable to process your order until your payment method has been received, credit / debit / charge card has been authorised or proof of address accepted. By submitting your order, you are offering to buy the goods, and allowing us to use your personal details for the purposes of supplying those goods (including passing your personal details onto couriers and other subcontractors). Personal details can be removed from our system by written request. If you have submitted your email address to our email marketing system, you may remove your details by just emailing us at sales@theaudioworksuk.com No items or title of the goods shall pass from The Audio Works Uk to the customer until payment has been received in full. Customers are responsible for the suitability of the goods they are purchasing. If any product supplied is not used for its intended purpose, subjected to abuse, or unreasonable usage will void the warranty on the goods. Please note we do not reserve any items at any time as it is unfair to other customers

8. AVAILABILITY OF GOODS - The Audio Works Uk go to great lengths to ensure that everything shown on our website and catalogue is available to order is in stock. However, due to the nature of our business, dealing in a huge selection it is inevitable that some of our items can go out of stock very quickly. We stock over 10,000 items and it is sometimes very difficult to keep every item in stock at all times. We are sometimes dependent on our own suppliers to deliver stock to us. Please be aware that our demo room is also open for cash purchase. All orders and special offers are therefore subject to the availability of stock when picking your order. All items are sold on a first come, first served basis so that all customers are treated fairly. Unlike most of our competitors our website is updated weekly with the lastest products and stock availability. We will always try to inform you if an item is not in stock when you place your order with The Audio Works Uk. When we receive your order we will ship everything that is in stock. Should any items be out of stock a carefully selected upgrade or replacement may be offered or sent should the circumstances and criteria suffice. Any items that are not in stock, and no suitable alternative be available at the time of picking, your order will be dealt with as per Section 9.

9. BACK ORDERS & DEPOSITS - If an item is out of stock and a credit / debit / charge card has been used to place the order, we will automatically make you a back order. If the goods return into stock within 12 weeks they will be sent straight out with no additional shipping charges, only a handling/backorder charge as indicated on our shipping page. However after the 12 week period we will notify you by email when the goods return to stock. You must then re order the goods by placing a fresh order. You may cancel your back order at any time at no cost and with no penalty by contacting us via phone or email. As with all orders you will only be charged when items are ready to be despatched to you. Please note that if you do not cancel your back orders, they remain an on-going order with us. When cancelling a back order with us please make sure you receive confirmation from us that it is cancelled. All back orders will be despatched to the card registered address for security reasons and will be shipped to you via business post next day service Customers who haven't paid by credit / debit / charge card will be notified by email when the item(s) become available again so they may place a fresh order for the item(s) if they wish to do so. This email notification service is FREE and there is no obligation to purchase the item(s). Please note that we do not reserve stock at any time as this is unfair to other customers unless a non refundable deposit is received.Deposits,all deposits to hold items are taken on a non refundable basis, If balance of payment to complete order is not received within 7 days of deposits being placed we have the right to sell the items held and will not under any circumstances refund any deposit received.

10. CREDIT / DEBIT / CHARGE CARDS - Credit, debit and charge cards are accepted but for some credit cards a surcharge may be applicable. When we receive your order, your payment card will be pre-authorised with your bank. Please note we will charge your card when your order is processed. We reserve the right to deliver any order to the cardholders billing address in the interests of protecting both the card holder and The Audio Works Uk against credit card fraud. Orders sent to a non card registered address are sent at the customers liability due to the higher risk of card fraud and a third party obtaining your order when sending to a third party address. If requesting an alternative delivery address please state this on your order, along with your card registered address. Unfortunately we will not ship any orders to university/college addresses due to the high amount of orders that go missing when sending to these type of addresses. In the interests of protecting all our customers against credit card fraud, you may be asked to provide us with proof of your address at anytime. If you refuse to provide us with this evidence, your order may be cancelled. If you are using a credit card not belonging to yourself, you must give the cardholder's full name and address. We will then contact the cardholder to obtain approval. The use of stolen credit cards will result in international police notification and court action in all cases.

8. CHEQUES - Personal or business cheques are welcomed but clearance is required prior to order shipping. This can take up to 5 working days from when we receive the cheque. Please note we only accept UK cheques. Unfortunately we are unable to reserve items whilst waiting for cheque clearance. If the item ordered is in limited supply, please include alternative items when ordering so that we can easily substitute your first choice to avoid any disappointment. IMPORTANT: Please ensure that you have written your full name and address on the back of the cheque together with your customer id number (if applicable).

9. BANKERS DRAFTS, BUILDING SOCIETY CHEQUES, POSTAL ORDERS, CASH, PAYPAL & DIRECT MONEY TRANSFERS - The above payment methods are acceptable and should clear immediately upon receipt. We accept cash sent by insured delivery. We accept only UK Pounds. Please note that we can't be held liable for any money lost in the post. Please do not send coins, we only accept notes. You may also transfer funds (or pay cash) directly into our bank account. Payment via Paypal needs to be sent to theaudioworksuk@yahoo.co.uk. For more info on all of our accepted payment methods please speak to our Sales Department to obtain further details. Please be aware that we are unable to reserve stock, while waiting for payment, or for payment to clear due to being unfair to other customers.

10. FINANCE AGREEMENTS - Finance is only available to UK customers over 18 years of age. You may apply online or via telephone. If you have paid for your order by finance then your contract will be with our finance Company. Full details will accompany your finance agreement. More info on paying for your order via Finance can be found on our how to pay page located under the Info and FAQ's menu.Please Note After 05.05.2009 We will no longer be offering  finance on any of our products.

11. SHIPPING - All orders are shipped in appropriate strong packaging. Most orders are computer tracked with barcodes and can be followed up at any time by contacting us. Orders shipped by TNT can be tracked via the TNT Website. Most other orders may be tracked using the tracking info available on the despatch email we send you when your order leaves our warehouse. We advise you to ensure somebody is present at the delivery address since most high value items require a signature upon delivery, we must also ask that all items are properly checked, if your goods or packaging have any signs of damage they must be signed for as damaged, if this procedure is not followed correctly it will most definitely void any claim being made at a later date.Once goods are delivered and signed for in good condition they become your responsibility. In the unlikely event you received your items damaged you must inform us in writing within 24 hours of delivery as after this we cannot make any claim for damages with our couriers. Orders sent to a non card registered address are sent at the customers liability due the higher risk of a third party obtaining your order when sending to a third party address. We reserve the right to alter the shipping option of an order in the case of certain items not being in stock. This will only be implemented on rare occassions to save you money on postage charges. If the unlikely event that your order is damaged or lost in transit, a replacement order will be issued. If we cannot supply an identical order we will issue you with store credit to use at a later date. Please note that we do not ship any goods to PO BOX addresses.

12. SHIPPING TIMES - Our orders are shipped and handled by third party couriers, therefore all delivery dates and times given are only estimates. We endeavour to get your order to you within the estimated delivery time, however, on rare occassions the delivery may be delayed. We therefore cannot be held responsible for delays by the courier / postal service or for any consequential losses you may suffer if the delivery is not on time for whatever reason. Orders being shipped to remote locations may, on rare occassions, be slightly delayed by the courier / postal service. Please also see section 19 if you are a UK customer or section 20 if you are a customer outside the UK for more shipping info.

13. SHIPPING CHARGES - Charges will be calculated on our website for online orders or quoted by telephone when ordering by traditional mail order. If your order is returned to us undelivered due to your own fault you will be responsible for re-shipping charges.

14. UK CUSTOMERS - Most orders can be tracked using the tracking info located on the despatch email we send you when your order leaves our warehouse. In the unlikely event that your goods do not arrive within 7 days of despatch, first call or e-mail us to confirm your order has been shipped and that we have your correct delivery address details. Normal delivery time after dispatch is approximately 1 to 7 days. However please allow upto 14 days during busy periods e.g Christmas Unfortunately parcels can not be declared lost in post until 15 working days have elapsed from the shipping date. We therefore cannot replace your order until the courier or postal service have confirmed that your parcel has been lost/damaged.

15. OVERSEAS CUSTOMERS - Most orders can be tracked using the tracking info located on the despatch email we send you when your order leaves our warehouse. In the unlikely event that your goods do not arrive within 29 days of despatch, first contact us to confirm shipping of your order and all delivery details are correct. Unfortunately parcels can not be declared lost in post until 29 days have elapsed from the shipping date. We therefore cannot replace your order until the courier or postal service have confirmed that your parcel has been lost/damaged. 16. IMPORT DUTY & TAXES It is your responsibility as the customer to pay all applicable customs fees and taxes for your country. If you refuse to pay these charges then your order may be abandoned and you will lose your goods as well as your money. These taxes are only applicable for non UK and non European Union countries.

17. DISCOUNT VOUCHERS - From time to time we will supply our customers with special discount vouchers and special offer promotions. These discounts will be available to use on the majority of our products, but not all. When placing your order you will be told/contacted if the discount is not available on that particular product. We reserve the right to withdraw any offer or discount at any time.

18. CANCELLATIONS - You may cancel any order before it has been shipped. Once your order has been shipped our 7 day returns policy will then come into affect after which is you will be charged a restocking charge of 15%-25% of the product value (depending on manufacturer)to cover all admin and incurred costs. If you cancel an order by email you must wait to receive a confirmation of the cancellation. Your order is not cancelled until you receive this. The ideal way to cancel your order is by telephone as orders can be cancelled instantly.

19. LATE PAYMENTS AND BAD DEBT - In the event that cheques have to re-presented for payment to the buyers bank, the seller reserves the right to pass on all asssociated bank charges. Further the seller reserves the right also to charge interest at the rate of 8% above prime overdraft rate on all payments outstanding for more than 30 days following month of invoice. If handed over for collection of debts, the debtor will be liable for all legal and collection fees.

20.FRAUD SECURITY CHECKING - Due to recent increase in card fraud all purchases over £500 MAY be subject to additional security checks all customers are advised we may need to contact you once you purchase has been made to confirm the indentity of the cardholder.We require all customers to enter a valid landline number that we can verify and contact you on .Depending on security score additional identification may be required before any high value goods are released.

21.RETURNS POLICY - This regulation only covers countries that are member states of the EU. If you are ordering from a member state of the EU other than the UK please check you countries regulations on Distance Selling as this may vary. If you are ordering from a country that is outside of the member states of the EU this regulation is not applicable, but we will do our best to adhere to these guideline in the way your returns are dealt with.You have the right to return any item ordered via this website for no reason and for a refund minus shipping charges. This excludes consumables and worn items ie stylus. Please refer to the exceptions section which outlines exemptions to your rights.To return an unwanted order are faulty item you must give us notice within 7 working days starting on the day after the day that you received the goods from us.Alternatively, you can e-mail us at returns@theaudioworksuk.com stating your full name - product tiltle purchase date and cancellation instructions. We shall refund the total amount of money paid by you for the goods, less any costs to collect the goods if required and the original postage fee charged when the product was purchased, this must be within 7 days starting from the day on which we receive notice of cancellation in writing from you and subject to the goods being correctly returned as detailed below. Clearance / End of line / Used / Ex demo products are exempt of distance selling regulations.

If you are returning an item under Distance Selling, you are still responsible for the return shipping costs and are entitled only to a refund of product  purchase prices minus original shipping charge.

Please note that any items returned under the Distance Selling Year 2000 Regulations will require a Returns Authorisation number and be returned as per our standard returns procedure.

HOW TO RETURN THE GOODS - WARRANTY REPAIRS & STANDARD RETURNS -  Before returning any items a RETURNS AUTHORISATION NUMBER (RAN) must be obtained only from our returns department by emailing them directly at service@theaudioworksuk.com, you will then be sent via email a returns authorisation number, outlining the procedure on how to return the goods to us or directly to relavent manufacturer or supplier. If no RAN number is clearly visible on the package upon return, it will be refused.All items being returned are the customer's responsibility until they have been signed as received by The Audio Works UK.Please note: Returns Authorisation Numbers must not be written anywhere on the manufacturer's packaging (please wrap original packaging in brown paper or shrink wrap then stick return label).If returning to us please return to - Our Reg Head Office Address  - The Audio Works UK- Unit 1 / 169 Woodcote Valley Road, Surrey, CR8 3BN.

YOUR LEGAL REQUIREMENTS  - We would remind you that once you have notified us of your desire to return an order there is a legal requirement for the customer to take a reasonable duty of care for the goods while in their possession. (Please see section below for our definition of reasonable duty of care)

REASONABLE DUTY OF CARE- (OUR DEFINITION)  - The reasonable duty of care is that a product is returned in the same way that the product was delivered including manuals, accessories, free gifts and any other items relating to the unit in question. Meaning free from damage (damaged in transit on return) or defect caused by any third party (not The Audio Works UK, manufacturer or the courier). This also means the product(s) can not have been used in any professional manner or have been self-assembled.

You must also return the goods to us via the same method they were shipped out (i.e sent Royal Mail returned via Royal Mail) This means that if the order was shipped out by our courier, the order will have to be returned via our courier. Please note that the above section is for customers returning items under the Distance Selling Regulations 2000.


1) Please note your right to cancel for a refund does not apply to items that have been opened or unsealed by the consumer. However you do have the right to cancel any order before it has been shipped.
2) Your right to return an order for a refund does not extend to customers who purchase from our store or have had a item delivered by a member of staff and tested / signed for on delivery. You have the right to return new goods ordered and collected from our store within 10 days for an exchange or credit note . ( this does not apply to ex demo or used or clearance items)
3) Our guarantee will be null and void if the item has been interfered with in any way by any unauthorised party, or misused in any way. Damage caused by external sources will not constitute a part of this guarantee and is therefore excluded.
